1. Supplier information
MUTI is a trading name of SZL Holdings (Pty) Ltd, a company incorporated in South Africa. Where these terms say “we”, “us”, “our” or “MUTI”, they mean SZL Holdings (Pty) Ltd, and your contract of sale is with that company.
You can reach us at info@mutivitamins.co.za, and this website is mutivitamins.co.za.
Section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA) requires an online supplier to make further details available, including its registration number and physical address. Those will be added to this section before MUTI begins trading.
2. About these terms
These terms apply every time you use this website or place an order through it. By placing an order you confirm that you have read them and agree to them.
Two other documents form part of these terms: our Shipping Policy and our Returns and Refund policies. Where they say something more specific than these terms, the more specific wording applies.
Nothing in these terms limits, excludes or waives any right you have under the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) or any other law. If any clause here conflicts with a right you have under those Acts, the Act wins and that clause does not apply to the extent of the conflict.
3. Who may order
You may order from us if you are 18 or older and legally able to enter into a contract. If you are under 18, you may only order with the consent and supervision of a parent or guardian, who takes responsibility for the order.
We deliver to street addresses within South Africa only. We do not deliver to PO boxes and we do not ship internationally.
4. Product imagery, including AI-generated visuals
We want to be direct about this, because you are buying something you cannot pick up and turn over first.
Some of the product and lifestyle imagery on this website is computer-generated, AI-generated or AI-assisted. It is a visualisation of the MUTI product and packaging design, not a photograph of a specific physical item taken from stock.
Imagery is intended to represent the product fairly, but it is illustrative. Colour, finish, texture, print detail, capsule appearance, pack proportions and the exact look of packaging may differ from what is shown on screen, and screens themselves render colour differently. Any props, settings or people shown are for presentation only and are not included in what you buy.
What is binding is the written product information: the product name, the supply length, the price, and, once it is finalised and published, the nutrient panel and directions for use. Where something has not been confirmed, the product page says so plainly instead of filling the gap.
If a product you receive is materially different from how it was described, that is a different matter entirely, and your rights under section 20 and section 56 of the CPA apply in full. See our Returns Policy.
5. MUTI is a supplement, not a medicine
MUTI is a food supplement. It is not a medicine. It is not intended to diagnose, treat, cure or prevent any disease, and it is not a substitute for a balanced diet, medical advice or prescribed treatment.
If you are pregnant or breastfeeding, taking medication, managing a medical condition, or preparing for surgery, speak to your doctor or pharmacist before taking any supplement. Do not exceed the recommended intake. Keep out of reach of children. Stop use and seek advice if you have an adverse reaction.
We do not make health claims that have not been cleared for use. Where our formulation or permitted wording is not yet final, this website says so rather than stating an amount or a benefit we cannot support.
6. Placing an order
MUTI is sold as a one-time purchase in a 30, 90 or 180-day supply. You pay once for the supply you choose. Nothing renews, and no recurring charge or standing mandate is created against your card or bank account.
When you place an order you are making an offer to buy. Your order is accepted, and a contract of sale comes into existence, only when we confirm to you that we have accepted it. Acceptance does not happen when you submit the form, and not merely because a payment was authorised or taken.
We will send you an order reference. Please keep it: it is the fastest way for us to find your order.
7. Stock, availability and our right to cancel an order
We hold limited stock and we do not oversell deliberately. Even so, stock can run out between the moment you order and the moment we pick it, and occasionally an order cannot be fulfilled for another reason, such as a pricing or listing error, a failed address or fraud check, or a delivery address we cannot reach.
So, clearly: we may decline or cancel an order, in whole or in part, even after your payment has been taken and even after you have received an order confirmation.
If we do, we will tell you as soon as we reasonably can and refund you in full: the full amount you paid for the cancelled items, including any delivery charge attributable to them. Section 46 of ECTA requires us to notify you and refund within 30 days where we cannot perform; we refund to the original payment method, and we do not wait for that deadline. We will not substitute a materially different product without asking you first.
This clause lets us cancel and refund. It does not cap what we owe you. Section 47 of the CPA deals with over-selling: where a supplier accepts payment and then cannot supply because of a shortage of stock, the consumer may be entitled to a refund with interest and, in some circumstances, compensation for costs directly caused by the failure. That right is not excluded by anything written here, and it is expressly not excluded where a shortage arises from our own failure to run the business diligently.
8. Prices, VAT and pricing errors
All prices are shown in South African rand and include VAT at the standard rate, currently 15%. The price you pay is the price displayed at the moment your order is accepted.
Delivery is currently complimentary on every MUTI order. Any amount payable is shown before you pay, and our full delivery terms are in the Shipping Policy.
We take care with pricing, but errors happen. If a product is listed at an obviously incorrect price, one you could reasonably tell was a mistake, we are not obliged to supply it at that price. We will contact you, and you may either confirm the order at the correct price or cancel it for a full refund.
We may change prices at any time. A change never affects an order we have already accepted.
9. Payment
Payment is taken through our payment provider's secure hosted payment page. MUTI does not see, handle or store your card number, PIN, banking login or any other payment credential.
We may decline an order where payment is refused, incomplete, or flagged by a fraud or verification check.
You confirm that you are entitled to use the payment method you present. Fraudulent use may be reported to the payment provider, your bank and the appropriate authorities.
10. Delivery and risk
Delivery timelines, costs and areas are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees.
Section 19 of the CPA applies to delivery. Unless we agree otherwise with you, we will deliver within a reasonable time; where we cannot, you may cancel and be refunded.
Risk in the goods passes to you on delivery to the address you gave us. Please give us an address where someone can receive and sign for the parcel. If an address is wrong or nobody is available, a further delivery charge may apply for redelivery.
11. Your rights to cancel, return and be refunded
Section 44 of ECTA gives you a cooling-off right: you may cancel this transaction within seven days of receiving the goods, without giving a reason and without penalty. You carry the cost of returning them, and the product must come back in the condition it arrived in.
Section 20 of the CPA gives you a right to return goods in defined circumstances, and section 56 gives you an implied warranty of quality for six months from delivery. If goods are defective, unsafe or not as described, you may choose a repair, replacement or refund.
For health and safety reasons we cannot resell a supplement once its seal is broken. That does not affect your rights above where the product is defective, unsafe or was incorrectly supplied.
Our Returns Policy and Refund Policy explain how to exercise all of this.
12. Using this website
You may use this website for browsing and for placing genuine orders. You may not use it to attempt to gain unauthorised access to any system or account, interfere with its operation or security, scrape or harvest it at scale, place fraudulent or automated orders, or misrepresent who you are.
We may suspend or refuse service to anyone doing any of these things.
13. Intellectual property
The MUTI name, wordmark, emblem, packaging design, imagery, copy, page designs and site code belong to SZL Holdings (Pty) Ltd or are used under licence, and are protected by copyright and trade mark law.
You may not copy, reproduce, republish or use any of it commercially without our written permission. Ordinary personal use of the site, like viewing it and sharing a link to it, is fine.
14. Services we rely on
We use third parties to run this business: a payment provider to take payment, a courier to deliver, an email provider, and analytics providers to understand how the site performs. Their services are governed by their own terms, and we are not responsible for their systems.
This does not reduce our responsibility to you for your order. If something goes wrong with a delivery or a payment, come to us and we will deal with it.
15. Availability of the website
We do our best to keep this site available and accurate, but we do not promise it will be uninterrupted, error-free, or free of every inaccuracy. We may change, suspend or withdraw any part of it, including any product listing, at any time.
16. Liability
Subject always to the CPA and to anything else the law does not allow us to exclude, we are not liable for indirect or consequential loss arising from your use of this website, for example lost profit, lost opportunity or wasted expenditure.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Section 61 of the CPA governs liability for harm caused by unsafe or defective goods, and is not excluded here.
Section 51 of the CPA makes certain contract terms void, and section 48 prohibits unfair, unreasonable or unjust terms. We do not intend any clause in these terms to operate as such a term. If any clause would, it does not apply to that extent, and the rest of these terms carry on.
17. Your personal information
We process your personal information in line with our Privacy Policy and POPIA notice, and only for the purposes set out there: principally to fulfil and deliver your order, to support you, and (only if you opted in) to send you marketing email.
You can unsubscribe from marketing at any time using the link in every email, or by contacting us.
18. Changes to these terms
We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order. A later change never applies retrospectively to an order we have already accepted.
19. Complaints, governing law and disputes
If something has gone wrong, tell us first: info@mutivitamins.co.za. Most things are quicker to fix directly, and we would rather fix them.
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
If we cannot resolve a complaint between us, you may refer it to the National Consumer Commission, or to a relevant ombud or accredited consumer dispute resolution body. Referring a dispute does not take away your right to go to court.
20. General
If any part of these terms is found to be unenforceable, the rest of them continue to apply.
If we do not enforce a right immediately, we do not lose it.
These terms, together with the Shipping, Returns, Refund and Privacy policies and your order confirmation, are the whole agreement between us about your order.
This document has not been finalised. It must be reviewed and dated by a qualified South African attorney before MUTI accepts orders.
